Immediate Media Company publishes Gardeners’ World Magazine and Gardenersworld.com under licence from BBC Worldwide Limited.

These terms and conditions apply to any purchases made from gardenersworld.com. They must be read together with our website terms and conditions, which you’ll find here. If there is any inconsistency between these terms and conditions and our website terms and conditions, these terms and conditions will prevail in respect of any purchase from gardenersworld.com.

1.             Who sells on gardenersworld.com?

1.1    The sellers on Gardenersworld.com are trusted suppliers chosen carefully by Immediate Media Company and invited to make their products available for purchase in the online marketplace provided on gardenersworld.com (“Our Website”) in accordance with these terms and conditions.
1.2           These terms and conditions form the basis of the contract between the supplier and you. When you make a purchase from Our Website, your contract is with the supplier and not with Immediate Media Company or gardenersworld.com. All of the contractual obligations arising in your transaction are owed from and to you and the supplier.
1.3    By purchasing products from the supplier, you authorise gardenersworld.com to take payment for these products on behalf of the supplier. Refund payments will usually be made by Immediate Media Company on behalf of the supplier.

2.             Pricing and availability of products

2.1           All prices on Our Website are shown inclusive of any VAT payable and exclusive of delivery costs (see part 3 below), unless otherwise stated.
2.2           If, by mistake, the supplier has underpriced a product, the supplier will not be liable to supply that product to you at the stated price, provided that the supplier notifies you before it dispatch the product to you.
2.3           All products offered by suppliers on Our Website are subject to availability or whilst stocks last. Should a specific variety not be available at the time of dispatch, or if items are of unsuitable quality to send, the supplier will supply a variety of similar colour and habit, and of an equal or greater value or send the item when available. This excludes fragrance products. If the supplier is unable to supply your chosen fragrance it will contact you for further instructions. If no suitable substitutes are available, the supplier will send you a credit note for future purchases or provide you with a refund.
2.4    Should you for any reason (including being unhappy with product substitutions) wish to receive a refund, you must return the product promptly as set out in part 5 below.

3.             Payment and acceptance of your order

3.1           Immediate Media Company is authorised by our suppliers to accept your payment for orders. In processing your payment and any refund, Immediate will be shown as the merchant of record on your credit card or bank statement and will be acting as the supplier’s agent.
3.2           Payment for your products will be taken at the time you place your order. Your order is an offer to buy from the supplier. Any order confirmation you receive, which may contain an estimated date of delivery or collection (as applicable), is not an acceptance of your order.
3.3           Nothing that the supplier does or says will amount to any acceptance of your offer until you receive an email notifying you that the supplier has dispatched a product to you. Where products are dispatched, the acceptance of the order in respect of each product takes place when you are notified by email of such dispatch.
3.4           Once the supplier has dispatched your order, you cannot amend your order but please see your right to return any order, set out in part 5 below.
3.5           At any point up until the supplier has dispatched your product(s), the supplier may, in its absolute discretion, decline to supply a product to you. If the supplier declines to supply a product to you and you have already paid for it, the supplier will issue a full refund of any amount already paid for that product in accordance with its refund policy.

4.     Delivery


4.1           Delivery will be made to the address specified when you complete the order.
4.2           Please note that suppliers only deliver to addresses within England, Scotland, Wales and Northern Ireland.
4.3           Suppliers use a variety of delivery methods and are responsible for setting their own delivery charges. Most seed orders are shipped within five working days of receipt of order. For plants, bulbs, fruit and potatoes approximate delivery dates are detailed on the product pages and on order acknowledgements. While suppliers will do their very best to make delivery within this timeframe, weather conditions and natural light levels can affect plant growth rates and therefore may cause delivery dates to vary. If your order is likely to be delayed by over two weeks from the indicated delivery window, our supplier will write to you and advise new delivery times. However, it is also possible that plants may be dispatched earlier than indicated.

5.             Return and refund policy

5.1           Our suppliers promise to supply products in prime condition. If for any reason you are not completely delighted upon receipt of your order, please advise the supplier by emailing gw-info@thompson-morgan.com or writing to gardenersworld.com offers, Customer Care, Poplar Lane, Ipswich, IP8 3BU within seven days. A replacement will be sent promptly to ensure you still have time to achieve total satisfaction from your purchases.
5.2           In the unlikely event that you are not satisfied with your seed germination, please write to the supplier within 30 days of the prescribed germination time (specified on the seed packet, catalogue or online product page) enclosing both the outer packet and inner foil sachet.
5.3           If any items do not come up to your expectations when you receive them, the supplier will offer a replacement (subject to availability), or credit, or refund the purchase price. Just notify the supplier within seven days of receipt of the goods.
5.4           If your plants show no signs of healthy growth after potting or planting, providing you followed exactly the instructions supplied, the supplier will replace, credit or refund the purchase price if you contact the supplier within 30 days of receipt of your order.
5.5           If any item supplied in a dormant state (e.g. bulbs, bare root perennials) fails to flourish the next season, please let the supplier know and it will endeavour to replace the product at the appropriate time or credit or will refund the purchase price.
5.6           Any plant or bulb that fails to grow true to name will be replaced, credited or refunded.
5.7           The supplier will not accept responsibility for items that fail to grow due to extreme weather conditions, over or under-watering, or which have not been cared for according to the instructions supplied.

6.    Payment of refunds

6.1           If you return a product to any supplier:
(a)       because you have cancelled the contract between you and the supplier within the seven-day cooling-off period (as set out in part 5.1 above), the supplier will process the refund due to you as soon as possible and, in any case, within 30 days of the day on which you gave notice of cancellation. In this case, the supplier will refund the price of the product in full and any applicable delivery charges. However, you will be responsible for the cost of returning the item to the supplier.
(b)       for any other reason, the supplier will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. It will process the refund due to you as soon as possible and, in any case, within 30 days of the day on which the supplier confirmed to you via e-mail that you were entitled to a refund. You will receive a refund equal to the full price of a defective product, any applicable delivery charges and any reasonable costs you incur in returning the item.

8.         Amendments

We may update these terms and conditions from time to time. If you do not wish to accept the new terms and conditions, you should not continue to use Our Website. If you continue to use Our Website after the date on which the change comes into effect, your use of Our Website indicates your agreement to be bound by the new terms and conditions.
